Présentation du service

This measure aims to verify the  procedures followed by the  management of the establishment for  this purpose.  It also plans to control  the members of the business advisory  committee or the monetary deputies.  Therefore a copy of the minutes of the  election of the company advisory  committee or the monetary deputies  must be submitted by the employer to  the territorially competent labor  inspectorate during the week of the  elections 

Grant conditions /Legal framework

Granting conditions

  • The applicant must be acting as an employer
  • The competent establishment must be subject to the provisions of the labor code
  • Whether the establishment is affiliated with the referent to the Labor and Reconciliation Inspectorate or to the territorially local unit
  • That the competent company employs at least 40 permanent workers in relation to the election of the company advisory committee which employs permanent workers equal to or greater than 20 and less than 40 for workers' representatives

Legal Framework :

  • Provisions of article 157 (new) of Labor Code
  • Provisions of Decree No. 30 of January 9, 1995, relating to the composition and conduct of the company advisory committee and the procedures for electing workers' representatives in the exercise of their functions

Submission of file / Service Delivery Deadline

  • The voting process must take place at least 35 days from the date of hanging of the notification of the call for elections
  • Immediately after the counting process, the electoral office prepares a report that includes the election results
  • The employer hangs up a copy of the report within the following twenty-four hours and sends a copy within one week to the labor inspection and territorially competent reconciliation office.
