Collective request to the dismissal  control commission  The request must include the  following information: 

• Company’s Name and address,  its Manager’s surname and first  name the start date of its activity  and the nature of the activity;

• The reasons for the request of  dismissal or unemployment.

 • The request must also be followed  by the necessary justifications for  the request of dismissal or  unemployment and by  list of names of all workers indicating their marital status, recruitment  date and their professional  qualifications as well as those who  are concerned either by the  dismissal or the unemployment.

The extension could not affect a  maximum of one month and 03 days  during the agreement concluded  between concerned parties  

Procedures

1. The labor inspectorate must  carry out an investigation 

2. Attempts at conciliation by the  two parties concerned 

3. Gathering of the central  commission or the regional dismissal  control commission

Notes

The request could be rejected if it is  not serious or expresses an opinion  on a procedure other than that  proposed by the employer.

Privileges

Due to lack of agreement, the two  parties retain their right of recourse  to the competent courts. Workers  can also have recourse to the courts  in the event that they do not receive  their benefits.
